I don't consider it a problem as

(a) this is an album I'm buying once released anyway.

(b) I'm not funding any pirate activity. I'm not paying for this stuff so the person sharing makes no money from me.

I know thats my distinction and not theres but as I'm not buying, selling or distributing to reduce the profits I don't see the problem.

If they caught me selling this stuff for £5 on a car boot sale then I can see thier issue.

It is rather scary though as that particular user says he used the Bittorrent platform - distributed parts of a single file to minimise risk of a single point of origin / complete source file being targetted. To me it proves that the IP Holders are infiltrating/participating in the file trading networks to ensnare users and they are using the exact process Woz outlines above of logged -> automagic complaint to ISP "Cease and Desist". Though if such a case went to trial would not Entrapment be reasonably claimed by the defendent? More worrying because there's all the potential on dynamically assigned IP networks for the wrong user to be targetted if a system time is squiffy or someone gets the time zone conversion wrong or transposes the wrong IP address. I remember a story on Ars Technica about exactly this where an ISP in the USA suspended a man's cable modem service on receipt of a DMCA Takedown Notice from the MPAA for alledgedly making available screeners / DVD rips on IRC. Not only did the man deny doing this - but could prove he was not using the PC at the time as he was on holiday. He suggested that perhaps his IP address had been transposed incorrectly or the date had been misinterpreted. Neither his ISP nor the MPAA would entertain any request for the evidence to be reviewed so he had to sign a letter of apology to the MPAA and agree to never do what had not done in the first place to get his cable modem service back :nuts:
